Terms of payment and delivery
  • Delivery: The date agreed for delivery is generally without obligation, unless it is confirmed as a fixed date. medica aims to stick to agreed delivery dates. In case we can not meet delivery dates culpable customer is bound to grant an additional respite. Partial shipments are acceptable in reasonable amount. 
     Within Germany deliveries with a net value of 150,00 EURO are free of carriage and packing charges. Up to an order value to 30,00 EURO (net) we invoice an extra charge for small quantities.
  • Payment instructions: 
    - New customers: Payment in advance
    - 10 days net with 2% cash discount
    - 20 days net

  • Reservation of proprietary rights:  The delivered goods remain, until full payment of the purchase price, our property. If the customer defaults on payment we are entitled after monition to demand, return of the goods without previous withdrawal on our part. The customer is entitled to resell the reserved goods. He assigns to us already now all claims in the amount of the invoice, which arise from the resale.

  • Liability in case of defects: The customer must inspect the goods immediately on the amount of defects and quality. The goods shall be deemed approved if identifiable complaints are not reported immediately in writing no later than within 1 week of receipt. Visible transport damage must be reported immediately and noted on the delivery receipt. If deficiencies or lack of due quality of the delivered goods at our discretion, we can eliminate the defect or replace the defective goods.

  • Law and place of jurisdiction: The legal relationship with the customer succumbs German law under exclusion of UN sales law (CISG). Place of jurisdiction is at the headquarters of medica. medica has the right to choose any different place of jurisdiction.  

  • Prices:
    Prices are valid until 31.12.2011.
